PRESS RELEASE: Troy Birthisel Update

Troy Birthisel is an Australian citizen who has been locked up in Cebu City jail in the Philippines going on 9 years in October this year and has been before the court over 50 times without being charged or committed to trial. The process he is engaged in is wearing him down mentally.

He is due to appear again next month despite the fact that the Philippines government has ordered in April 2020 to release prisoners who have not been charged due to COVID concerns and have recognised in recent law changes that prisoners who have not been convicted after 20 court appearances should be released. Further, their Immigration Laws state that Troy is an alien in that country and should be deported but he is ignored at every level.

Further, he has not seen his last born child and remains in a COVID ridden jail (with no fresh water or power since the Typhoon last month). Despite our best efforts, his family have, with my support, tried to have him released in many ways but a complicated and corrupt Philippines Legal System does not allow for that.

We have tried to seek his release through the Public Attorney’s Office (PAO), the President’s Complaint Office, the Philippines media, the Philippines Embassy in Canberra, the Catholic Church in the Philippines, Cebu lawyers ( who don’t answer email requests to represent him in court), Amnesty International, the UN and the Australian Foreign Affairs office.

Could the Australian media please support our efforts as we will all have to bear some guilt when he dies there as he surely will?
