PRESS RELEASE: Federal Court Approves $8.7 Million Settlement in Exactech Class Action

GMP Law announces that the Federal Court of Australia has approved a $8.7 million settlement, inclusive of legal costs, in the Exactech Class Action. The Court found that the settlement is fair, reasonable, and in the best interests of group members.
The class action alleged that Exactech Australia and Exactech Inc. manufactured and supplied defective shoulder, hip, and knee implants that were later subject to product recalls.
The settlement was reached without any admission of liability by the Respondents.
Individuals who underwent joint replacement surgery between 2003 and 2024 involving a recalled Exactech device may be eligible to participate in the settlement.
Compensation will be administered under the Court-approved Settlement Distribution Scheme (SDS). The Scheme sets out the process by which GMP Law, as Administrator, will assess eligibility and allocate compensation fairly and consistently across all claimants. Because the settlement fund is modest, largely due to Exactech US entering Chapter 11 bankruptcy and the financial uncertainty surrounding the Australian entity, the Scheme provides a contribution toward non-economic loss rather than full damages.
Over the coming weeks, GMP Law will open a formal registration process for group members wishing to participate. Registrants will be assessed under the SDS and placed into one of five compensation categories, ranging from $500 to $6,000 depending on the severity of their injuries and any revision surgeries. Compensation will not be paid immediately. Before any distribution occurs, all claims must be assessed, eligibility confirmed, and Court-approved deductions applied, including legal and administration costs and any required third-party recoveries.
